Moalboal, April 2008

Hi, friends of Moalboal!!

Great weather now in Moalboal. We had very unusual weather November
to February and not good at all. It's now warm and sunny and my
favorite time of the year. 28 Celsius in the water.

Chicago and I are out working again. This time only for 2 months. We
are in Florida now but will take a boat over the Atlantic Ocean to
Italy; you can look at the boat at: http://www.yachtkismet.com

Chili that have had problem with the landlord has now moved across
the street. Chili is now in old Balay bar. There are a lot of rumors
why Chili moved and if you want to hear my side of the story you can
read more at the end of this letter.

Could some of you readers please take some videos from Moalboal and
post them on U-tube? Send me the URL and I will post it in the
mailing list.

ACTIVITIES:

Moalboal Pool championship every Wednesday at Chili Bar. Starting
20:30

Jochen, Planet Action, is still making sure that there's soccer every
Monday and Friday up in Moalboal. If you want to play, just show up
16:30.

PRACTICAL:

There is now a list at the notice board in Chili Bar where you can
tell your friends to sign up for the newsletter. Or just have them
send me an e-mail.

There is a new Japanese restaurant across from Hannah's restaurant. I
have not tried it yet but it should be ok.

They are redoing some of the market up in Moalboal. All the old small
shacks have been removed and soon proper stalls will be built.

There's finally a proper shuttle bus between the Domestic and
International airport in Manila. It always used to be a fight with
taxi drivers there before.

Kasai Village has a good diving deal at the moment:

WHALE SHARK SIGHTINGS:

To get the absolute latest whale shark sightings go to Chili Bar and
look at the notice board there. Anyone putting up a sighting receives
a free Ning-Ning drink.

Lot's of people see whale sharks now. There's also the biggest school
of sardines ever seen just outside Nelsons dive shop stretching all
the way up to Chili

ACCORDING TO NELSON (our diving politician)

The water problem that has been haunting us the last few years might
have a solution now. They have located another source up in the
mountains that have more than double the capacity of the existing
Busay spring. The government will pay for the project and there's
bidding going on.

THE CHILI STORY!

This is my side of the story and you should always hear both side of
a story before you make up your mind.

Chili started with 5 happy guys that wanted a nice place to play pool
and drink beer at. Fun had much more priority than profit.

A year later one of the owners, let's call him Mr. A tried to buy the
building, that Chili was renting, without letting the other owners
know. Well, as you know, it's very hard to do secret things in
Moalboal. We did however let him buy the building and he promised
that future lease contract would not be a problem.

Later Mr. A sold his shares in Chili with a profit. We bought his
share.

Well, now is when the problem started.

Mr. A wanted to have part of the profit from Chili (dividends from
shares) and that after he had sold his shares. Well that is like
selling the cake and then later try to eat it. He also wanted Chili
to pay for all the costs he had buying the building like trips to
Cebu, lawyers, and so on?????.hmmm should not the landlord pay for
that??!??

The Chili owners are nice guys and agreed that we would help him with
money if he could come up with a new good 5 year lease contract. The
contract Mr. A came up with was not good at all, one sided on a few
points unacceptable so we decided to stick with our old lease
contract.

Late last year we honestly thought that rent had to be paid by the
end of November but it was actually October. November 16 I contacted
Mr. a and said that he could get rent whenever he wanted but by then
he had already contacted his lawyer and we got a letter that we had
to leave the building within 90 days. COME ON??what kind of fun is
that. We paid rent on time for 4 years and then we were 20 days late
with one month rent??..AND NOW THIS. Mr. A is obviously trying to
take over the bar in a very slimy disgusting way. That might work in
a big town but on the beach????.??!??

Philippino law is quite clear that you can not be evicted by being
late with rent and having all intention and means to pay. We have now
deposited money in Barili court for the rent.

And now the latest is that we have been sued by Mr. A ???.and the
story goes on. Old Chili might now be closed until the court case is
cleared??..and that might take many many years.

The good thing is that the new chili is open and up and running. We
had an opening party march 28???lots of good people and free beer.
Two pool tables and ocean view. Kicki (Kicki Ba) is serving breakfast
and lunch in the bar.
